Then again I suppose it's believable you'd do the washing with blood over the machine before calling the police with acting worse than that on Shortland street.

Benson take my picture off your profile ffs!

Did you know that when they first locked him up his cellmate said to him "David when you are in here you will make a lot of friends but for gods sake what ever you do please please for the love of god dont treat us like one of the family"

Doesn't really matter now - hung jury kinda says it all - just get ready for your taxes to shell out oooooo let's say $15million in compensation for being a pillow biter for the past 13 or so years

Well he will have to fight got compo.
The best book written about the trials was by a real journalist but I've forgotten his name.
However its much like a play. The defence line up was pretty good. I have no idea of the crown solicitors 'batting average'.
A trial 15 yrs after the event is horrendous without a 'cough'.But it was necessary to prevent him claiming any compensation straight away. What probably helped it was the admissibility of pure 'hearsay' evidence about his sister her alleged child and her alleged work as a whore.EVEN WORSE was the allegations that her father was rooting her!!!!!! this was all opinion and apparently left to go unchallenged.
Juries aren't impressed either when crown witnesses like policemen try and play word games with QC.s that is an art trust me.(we always knew where they lived and in fact had drinks with them after most trials win or loose)
But always consider this : this is our system of Law good or bad, it could be you one day.Don't confuse Justice with Law. Don't expect Justice through Law.

He who yells the loudest and has the biggest bank balance usually wins..

I agree Wabli Law is not always justice...

It's that thing called beyond reasonable doubt.....

My apologies, my sources were incorrect jury was unanimous. If you haven't read the front page of the paper today then I'd recommend doing so - evidence by the crown not admissable in court - crock of shit imo

Guilty. His actions on coming home, his bad acting on his phone call, his not batting an eye when people discuss his family being slaughtered, the evidence that couldn't be used against him (which I haven't seen yet lol).

Speirs, is there an online version? Paper papers are so archaic!

He shouldn't get compo anway, he has to prove he's innocent, and he can't do that... especially when he did it :P

AH Bollocks....................he has been proven not guilty he should get Compo for the 13 odd years in prison.

People are making a call on his guilt or innocence based on snippets of biased information from the media.

The jury made a call based on 3 months of evidence from a range of witnesses and experts from both sides.

From my perspective and this is only my opinion the cops failed to gather all the evidence and made some basic mistakes in the other evidence they did gather......it appears they assumed that the last man standing was the killer and excluded other possible options........How about Robin killed the family and David killed Robin? Tons of evidence was placed on the time on the computer in the first trial...

My wife was in Dunedin at the time and there was a lot of talk about Laniet being a prostitute, most of which was disallowed in the first trial removing the defence team the opportunity to present a possible other motive, and killer.

rant rant rant

Yea I understand where you coming from Hobzee but.............
the folk of Dunedin could say the Bain girl could have been an alien for all i care and support this with an alleged M8 who remembers her telling her so.
The defense never produced anyone who rooted her for money or reward. So its farking heresay and should never have been admissible but hey it happens.
Robin WAS the primary suspect and for the first 48hrs this was a simple murder suicide and if i was there thats they way i would've handled it. Why ? it easy to close the file and still have clearances for 5 homicides.Bury the dead let the house flame and big ears is a nerd so who cares?
What we witnessed was not a murder trial. it was the end of a chapter in our modern age.
If we place too much weight on the cost the next chapter opens. We will have contractors for a less expensive conclusion.
At the end of the day that was one farked up whanau that still is in the pool.

That's not true Hobz... he was not proven not guilty. He was not proven guilty beyond a reasonable doubt, there's a huge difference.

Massive difference - but in saying that Hobz is right the investigation was let's be honest shit, even if Police did nothing wrong/illegal in planting evidence etc they didn't do the most basic of things - cover your ass. far too many opportunities were in this re-trial for the defence to rip shit and bust the police investigation and label credible witnesses unreliable. NOT 100% this man is guilty, but from what I've seen of his demeanour after the conclusion of the trial was more relief than genuine happiness. it's one of the hardest things to accept - only david bain knows if he is guilty or not, we'll never really know

How can you kill yourself with a gun and not leave finger prints on the dam thing? and why wouldnt you just put the dam thing under your chin and pull the trigger but no he held it to his head at some funny angle..... F.U.B.A.R

mmmmmmmm it was a funny angle wasn't it, would the killer need to be lying down to get that shot if it wasn't suicide or a lucky shot from the hip.

Personally i think if anything happened...it was Robin killed the family David killed him............

But hey i am guessing and the only one who knows for sure is David and the dead....depending on your belief he will get sorted when he dies.....

There's a world of difference between "Not guilty" and "innocent". I understand that the courts in Scotland can award a finding of "not proven" - that may be more appropriate here.
